i. services we provide

We offer a wide and varied range of services which are subject to these Terms. Specific services include:

1. Browsing

Refers to the browser as a neutral network tool for third parties to provide information storage space services, linking services, information display platform, to facilitate you through through the URL, bookmarks, bookshelves, browsing history, search, download or by a third-party website set up in other ways, fast access to the network of web pages, text, media, applications and other content services.

2.Search

Lemur Browser, third-party companies through the Internet to provide you, according to the keywords you type for you to show the search engine based on the relevant technical standards or agreements included in the third-party websites, content services. Unless there is a special statement, any third-party web pages linked to through the use of the search are produced by others, the search engine's inclusion and display of behaviour are automatically triggered, does not mean that we agree with the content of the third-party web pages linked to by the search or position, and does not mean that we are responsible for its security, correctness and timeliness.

3. Integrated Services

Third-party applications, scripts, plug-ins, etc. installed on the Lemur Browser. Unless otherwise stated, such services installed and used by users through various channels are developed by and are the responsibility of third parties.

4.Security Services

Lemur Browser may help you to filter out (or alert you to the presence of) objectionable/malicious content on the Website.

We will use our best endeavours to ensure that the Lemur Browser and the technology and information it contains is secure, effective, accurate and reliable, but you understand that we cannot guarantee this due to the limitations of the technology available, except as expressly provided by law or regulation. Register account

Some of the services of Lemur Browser are provided to registered users only. If you use the network storage space provided by Lemur Browser for uploading and dissemination of text and other contents, etc., please first register as a registered user in accordance with the rules and procedures prompted by this Agreement and other Lemur Browser rules and ensure the authenticity, correctness and completeness of the registration information, and if the abovementioned registration information is changed, you should change it in a timely manner.

ii. scope and limitation of liability

1. Services provided by third parties

As users use the Lemur Browser, they may call a third-party system or support the use or access of users through a third party, and the results of the use or access are provided by that third party.

Therefore, we do not guarantee the security, accuracy, validity and other uncertain risks of the services and content provided through third parties, and we are not responsible for any disputes or damages arising from them.

You should use your own judgement with respect to such third party content and bear all risks associated with the use of such resources. We cannot and will not be liable for any loss or damage arising from such risks.

2. Force majeure and third party causes

We fulfil our basic guarantee obligations in accordance with the law, but we are not liable for any interruption of service, deletion of data or failure of storage to meet your requirements due to the following reasons:

(1) Force majeure factors such as natural disasters, strikes, riots, wars, government actions, judicial and administrative orders, etc;

(2) Due to power supply failure, communication network failure and other public service factors or mobile communication terminal virus or hacker attack, system instability and other third-party factors;

(3) Factors such as routine or emergency equipment and system maintenance, equipment and system failure, network information and data security, etc., in the case that we have done our best to manage the situation in good faith.

3. User Reasons

Personal injury or incidental or consequential damages, including but not limited to loss of profits, loss of data, business interruption damages or other commercial damages or losses, arising out of or in connection with any of the following circumstances shall be borne by you:

(1) Use of or failure to use the Lemur Browser;

(2) Unauthorised use of the Lemur Browser or alteration of your data by a third party;

(3) Costs and losses incurred in connection with your use of the Lemur Browser;

(4) Your misunderstanding of Lemur Browser;

(5) When the service cannot be provided due to your location, the off status of your communication device, etc;

(6) Other losses related to Lemur Browser that are not caused by us.

4. User Content Disclaimer

You understand and acknowledge that when using Lemur Browser, you are exposed to content and information from a wide variety of sources, and that we cannot be responsible for the accuracy, authenticity, usability, security, completeness and legitimacy of such content and information. You understand and acknowledge that you may be exposed to content and information that is inaccurate, offensive, inappropriate or objectionable, and you will not hold us liable for this.Content on Lemur Browser means any information, material, text, software, music, audio, photographs, graphics, video, messages, links or other materials, whether publicly or privately transmitted, uploaded, posted or in any other way transmitted or disseminated through the services provided by Lemur Browser (hereinafter referred to as "Content"). Content providers and uploaders shall be fully responsible for the content they provide and upload, and shall also be liable to Lemur Browser for any damages caused to Lemur Browser. In the event that a third party claims rights against Lemur Browser due to Content uploaded by a user, Lemur Browser reserves the right to directly take necessary measures such as deleting, blocking, or disconnecting the Content without prior notice to the Content Provider or Uploader.

5. Privacy Data

We may record information about your use of the Lemur Browser that is necessary for us to provide you with the information you need when you request it, or in the event of a regulatory review, compliance or forensic investigation by a relevant government regulator.

We undertake to maintain the external confidentiality of your data, not to disclose your data to third parties and not to authorise third parties to use your data unless:

(1) It can be provided in accordance with these Terms of Use or other terms of use, contracts, online terms and conditions between you and us;

(2) Should be provided in accordance with the provisions of laws and regulations;

(3) We are required to provide it by administrative, judicial or other authorities;

(4) You agree that we provide to a third party;

(5) Submitted for the purpose of resolving reported incidents or filing lawsuits;

iii.User Usage and Behaviour

1. Account security

Since the account function provided by the Lemur Browser provided by us only supports bookmark synchronisation, you will be fully responsible for the account password and all actions performed when logging in to other websites linked from the Lemur Browser.

2. Prohibition of Tampering with the Integrity of the Software and Services

Without the written permission of the Company, any user, third party shall not carry out including and not limited to:

(1) Reverse engineering of the Lemur Browser, such as disassembling and decompiling;

(2) Modifying or destroying Lemur Browser and its services in their original state;

(3) Interfering or attempting to interfere with any user or any other party's access to the Platform Services;

(4) Not to make any changes to the source pages of Lemur Browser and its related services in any form whatsoever, including, but not limited to, homepage links, advertisement system links, content API interfaces and other entrances, or any form of obstruction, insertion, pop-up windows and other hindrances to the display of the source pages of Lemur Browser and its related services.

3. Prohibition of simulation or theft of information or data

Without the written permission of the Company, any user or third party shall not carry out any activities including and not limited to:

(1) Imitating the appearance and functionality of the Lemur Browser through any "framing", "mirroring" or other techniques;

(2) directly or indirectly steal the video, graphic and other information content of the Lemur Browser and related services in any way (including but not limited to chain stealing, redundant stealing, illegal crawling, simulated downloading, deep linking, fake registration, etc.), or delete or change the rights management electronic information of the related information content in any way (including but not limited to hiding or modifying the domain name, platform-specific logo, user name, etc.);

(3) Accessing the Lemur Browser, collecting or processing content provided through the Lemur Browser through the use of any automated programs, software, engines, web crawlers, web analytics tools, data mining tools or similar tools;

(4) Adopting any form of identification methods including but not limited to special logos, special codes, etc., to generate, on its own or to assist a third party to generate traffic, readership guidance, transfer, hijacking and other adverse effects on the information content of the Lemur Browser and related services;

(5) It shall not capture, count, or analyse the data of Lemur Browser's user behaviour and operation behaviour, and shall not publicize, provide, or disclose the said data to any third party in any way.

4.Prohibition of endangering network security

Without the written permission of the company, any user, third party shall not carry out including and not limited to:

(1) Use of unauthorised data or access to unauthorised servers/accounts;

(2) Entering the public network or other people's operating system and deleting, modifying or increasing the stored information without permission;

(3) Unauthorised attempts to probe, scan, test the weaknesses of the Software system or network or otherwise commit acts that undermine network security;

(4) Probing or testing the Lemur Browser, the System, or another user's system for vulnerability to intrusion attacks, or otherwise circumventing (or attempting to circumvent) any security features of the Lemur Browser, the System, or another user's system;

(5) Intentionally spreading malicious programs or viruses and other acts that damage and interfere with normal network information services.

5. Prohibition of use beyond the purpose of software and service provision

Without the written permission of the company, any user or third party shall not carry out including and not limited to:

(1) Using the Lemur Browser to store, publish and disseminate information and content that violates national and local laws and regulations, industry practices and public morals;

(2) Using Lemur Browser for any commercial purposes or for the benefit of any third party;

Participating in any illegal or potentially illegal (we have the right to determine the user's behaviour and applicable rules and deal with them accordingly) activities or transactions, including teaching criminal methods, selling any illegal drugs, money laundering activities, fraud, etc.

iv.Intellectual Property Rights

Unless otherwise agreed or stated by us, all intellectual property rights (including but not limited to copyright, trademarks, patents, trade secrets, etc.) and related rights in and to all content (except for content that is copyrighted by the user in accordance with the law), technology, software, programs, data, and other information (including, but not limited to, text, images, graphics, photographs, audio, video, diagrams, colours, layout, electronic documents) contained in the Monkey Browser are owned by us. All intellectual property rights (including but not limited to copyright, trademarks, patents, trade secrets, etc.) and related rights belong to us. Any unauthorised use (including but not limited to copying, distributing, displaying, mirroring, uploading, downloading, modifying, renting) without our permission is prohibited.

Logos, icons and other marks, symbols, product and service names of Lemur Browser are our trademarks in China or other countries, and may not be displayed, used or otherwise dealt with in any way that suggests to others that you have the right to do so without our written authorisation.

We have full intellectual property rights in and to Lemur Browser's proprietary content, original content and other content licensed to us on an exclusive or proprietary basis. Without our permission, any entity or individual may not reproduce, distribute, or provide viewing services or otherwise infringe upon the intellectual property rights of Lemur Browser, or they will be held liable for all related legal responsibilities.

V. Default and treatment

1. If one of the following situations occurs, it is regarded as your breach of contract:

(1) Violation of relevant laws and regulations when using Lemur Browser;

(2) Violation of the Terms of Use or other supplementary agreements.

In order to adapt to the development of the Internet industry and to meet the demand for efficient and high-quality services from a large number of users, you understand and agree to the procedures and standards of Lemur Browser regarding the determination of breach of contract.

2. Measures to deal with breach of contract

(1) If your behaviour on Lemur Browser, or your behaviour which is not on Lemur Browser but affects Lemur Browser and its users, constitutes a breach of contract, we may suspend the provision of part or all of the services to you in accordance with the corresponding rules and take other measures to deal with the breach of contract.

(2) If your behaviour on Lemur Browser violates the relevant laws and regulations, we may report and submit your usage records and other information to the relevant competent authorities in accordance with the law.

(3) If your behaviour causes Lemur Browser and/or its affiliates to suffer losses (including its own direct economic losses, loss of goodwill, and indirect economic losses such as compensation, settlement, attorney's fees, litigation costs, etc.), you shall compensate for all of the above losses.

If your behaviour exposes Lemur Browser and/or its affiliates to the claims of third parties, Lemur Browser and/or its affiliates may recover the full amount of the losses from you after you have assumed the obligation to make monetary payments to the third parties.\

VI. Application of Laws and Dispute Resolution

The conclusion, entry into force, interpretation, revision, supplementation, termination, enforcement and dispute resolution of these Terms of Use shall be governed by the laws of the People's Republic of China; if there is no relevant provision in the law, reference shall be made to commercial practices and/or industry practices.

Any disputes arising out of or in connection with your use of Lemur Browser shall be resolved by negotiation between us and you. In the event of failure of negotiation, either party may file a lawsuit in court.
